General Terms of Use and Provision of Services

  1. Agreement between Client and Adria databanka

    You agree to comply with the below mentioned rules and terms when using this website and/or the services hereby presented. These terms apply to the whole offer of services presented on the Internet pages of www.adriadatabanka.com. The volume of tour services provided by the travel agency of Adria databanka, s.r.o. (herein after referred to as ‚Adria databanka‘) is secured by agreement against bankruptcy of the travel agency, for the benefit of client. The Terms of Use of the website are set with regard to protection of client, protection of Adria databanka and/or protection of other Internet users against unlawful and/or disrupting activities. Adria databanka provides accommodation rental service and/or tours, accommodation service in accordance with confirmed booking and information published, except for a Force Majeure event (see Clause 5). Services provided by Adria databanka for individuals, groups or corporate bodies are custom-made upon client’s order. Contractual relation between client and Adria databanka, or between client and authorised sales representative of Adria databanka, is guided by (1) regulations of Act 159/1999 Coll., as amended, on conditions of entrepreneurship in travel industry, and by (2) Act 40/1964 Coll., of the Civil Code, as amended.

    1. Contractual relationship between the client and Adria databanka is established upon accepting an Order of Service. Enquiries and orders are received via electronic mail, in writing, over telephone, personally in the Adria databanka office, and/or in offices of Adria databanka’s contractual partners.
    2. By submitting an order, the client confirms that they understand and accept all the General Terms of Use and Provision of Services. This implies that all information mentioned in the General Terms represents a legal liability for both the client and Adria databanka. The client is responsible for veracity of data stated in their order and is accountable for any misuse of personal data by an underage person, who shares the client’s household, for purpose of order placement. Should there occur any change in the number of persons (or animals) previously stated in the order, the client is obliged to inform Adria databanka immediately.
    3. Should desired accommodation unit be occupied at the time of receiving order, the client may be offered an alternative period of sojourn and/or other option of accommodation.  

  2. Accommodation Price

    The accommodation unit proposition states what is or is not included in the price of accommodation. Adria databanka is liable to the client for constant price stated in calculation, based on which client settled the advance payment. Should a greater number of persons than previously stated in the booking confirmation (Voucher) arrive to the booked accommodation unit, or should the client bring an animal with them without prior notice, the property owner reserves the right to reject the persons and/or animals, or accept them for a supplementary payment. In accordance with valid Sojourn Tax Act of the destination country, the client is obliged to pay Sojourn Tax simultaneously with payment for accommodation services. Majority of accommodation units offered by Adria databanka have Sojourn Tax included in the price of accommodation. There is a selection of accommodation units where Sojourn Tax shall be paid upon arrival to the destination place. Such exception is distinctly marked in the relevant price list.

  3. Terms of payment

    An advance payment, amount of which is stated in the DO NOT MISS paragraph at the end of the unit description, has to be paid at the time of order placement. The advance payment already includes commission for Adria databanka. The issued deposit invoice is due in 7 days since delivery. Due date of the deposit invoice may be extended upon client’s request. Should the client fail to meet the due day of payment, Adria databanka reserves the right to cancel client’s booking while the client is obliged to pay contractual penalty of CZK 1,000 / EUR 35. After the advance payment is settled, the remaining part of accommodation price is to be paid in Euros to the property owner upon arrival to the accommodation unit. The amount of supplementary payment is stated in the booking confirmation (Voucher), which is delivered to the client from Adria databanka together with other materials after settling the advance payment. (Following is other information provided by Adria databanka together with Voucher: information and instructions on journey and sojourn; optionally Travel Agreement for tour participant). Should the client settle 100% of the payment in the Czech Republic, no supplementary payment is stated in the Voucher.

  4. Liabilities and Complaints

    Adria databanka is liable to instruct its clients truthfully. Adria databanka is also liable for any prospective damage caused by property owner’s untruthful interpretation of provided information. The accommodation units‘ names, used on the www.adriadatabanka.com server, are merely operational names and thus may not be identical to the real local unit names. The accommodation unit owner is accountable for quality of ordered services as well as for veracity of information they made available to Adria databanka. The client is eligible to make a complaint about provided services immediately upon arrival to the accommodation unit and/or during the sojourn on condition that the client was not able to identify the subject of complaint immediately upon arrival. Should the client find a drawback, they shall phone Adria databanka office without any delay. Adria databanka employees shall evaluate validity of the complaint immediately and contact the respective property owner. Adria databanka will endeavour to exert sufficient pressure on the property owner so that the property owner eliminates the cause of complaint. The client is obliged to co-operate with the property owner and provide necessary co-action in problem solving. Should endeavour to rectify the subject of complaint fail, Adria databanka is obliged to secure accommodation in the nearest appropriate accommodation unit available. A negotiation to settle the complaint may be held if the following conditions are met: (1) Adria databanka was informed via phone about the subject of complaint at the time of the client’s sojourn (as mentioned above); (2) the client submitted the complaint in writing together with photographs and/or other evidence no later than 30 days after the client had paid for and finished their sojourn. A negotiation to settle the complaint may also be held personally in the office of Adria databanka no later than 30 days after the client finished their sojourn. After receiving the complaint, Adria databanka is to rectify the complaint in period specified by the law. Until Adria databanka has evaluated the complaint, the client shall not seek solution through third party or court of justice, and shall not provide any information to media.

  5. The right of Adria databanka to alter and cancel

    Adria databanka reserves the right of alteration based on agreement with the client. Adria databanka also reserves the right to cancel accommodation service in the event of unforeseen and/or unavoidable circumstance (e.g. illness or death of accommodation unit owner, natural disaster, earthquake, unacceptable hygienic conditions, unforeseen changes in political environment or in level of safety, practice of local authority etc.). In such event Adria databanka reserves the right to alter accommodation, on condition that a mutual agreement with the client is reached. Adria databanka shall provide substitute accommodation of the same or higher quality, for the same price as is confirmed in the booking. Should the substitute accommodation be available only in higher category, exceeding the price of the ordered accommodation by 10%, Adria databanka reserves the right to negotiate with the client and charge the client the difference in prices. Should no substitute accommodation be available, Adria databanka shall cancel accommodation and refund the client with the sum of money the client paid in compliance with the Application for Payment. 

  6. Charges for Order alteration and cancellation

    The client is granted a single free-of-charge alteration in order placement, concerning number of persons and/or period of sojourn. Any further alterations in order placement are charged € 15. Should alteration be unacceptable and the client cancel their order, the below mentioned terms of cancellation shall be applied. Should the client cancel the order before deposit invoice is issued, Adria databanka charges € 15 per such cancellation in order to cover expenses on Order Confirmation. Should the client cancel the order after the client received deposit invoice, Adria databanka shall charge 30 per such cancellation. Should the client, who wishes to cancel the order, find a substitute client who shall utilise the original order, without any alteration of the order (nor alteration of the price), this exchange shall not be charged. If Order Cancellation is received after advance payment was settled, the advance payment is not refunded. If Order Cancellation is received within 14 days prior to start of sojourn, Adria databanka reserves the right to charge the client with up to 70% of the remaining unpaid amount stated in the Voucher. Following are terms of cancellation valid for selected accommodation units: terms of cancellation for houses marked with unit code: 549/1-IS-RU-PR, 549/2-IS-RU-PL, 549/3-IS-RU-PR, 549/4-IS-RU-PR, 549/5-IS-RU-PL, 549/6-IS-RU-PL, 549/7-IS-RU-PL, 550/1-IS-RU-ML, 550/2-IS-RU-ML, 550/3-IS-RU-ML, 550/4-IS-RU-ML, 627/1-IS-PO-PO, 627/2-IS-PO-PO, 628/1-IS-RM-UM, 628/2-IS-RM-UM: sojourn cancellation fee applied within 21 to 15 days prior to check-in – 30% of price + bank transaction fees. Sojourn cancellation fee applied within 14 to 9 days prior to check-in = 45% of price + bank transaction fees. Sojourn cancellation fee applied within 8 to 2 days prior to check-in =75% of price + bank transaction fees. Sojourn cancellation fee applied 1 day prior to check-in = 90% of price + bank transaction fees. Sojourn cancellation fee applied on the day of check-in = 100% of price + bank transaction fees.
    Terms of cancellation for houses marked with unit code: 579-SD-OH-HV, 581-SD-OB-PU, 583-SD-OB-SU, 584-SD-OB-SU, 586-SD-OB-MA, 691-SD-RO-DT: Sojourn cancellation fee applied within 21 to 15 days prior to check-in = 30% of price. Sojourn cancellation fee applied within 14 to 0 days prior to check-in = 100% of price. Terms of cancellation for houses marked with unit code: 001-SD-OP-OP, 002-SD-PC-PC, 003-IS-PE-PE, 004-SD-OM-OM, 005-IS-RV-NG, 006-IS-RM-SA, 007-JD-OL-OL, 008-JD-OA-OA, 009–JD-SA-SN, 010-IS-RV-RJ, 011-SD-MR-MK, 012-SD-OD-DG: sojourn cancellation fee applied up to 40 days prior to check-in =10% of price. Sojourn cancellation fee applied within 39 to 15 days prior to check-in =50% of price. Sojourn cancellation fee applied within 14 to 0 days prior to check-in = 100% of price.

  7. Client’s liability

    The client binds to provide Adria databanka with necessary support in order to secure services, to deliver changes, to rectify complaints and/or to rectify insured accident. The client binds to:

    1. provide the names of underage fellow-travellers even if the client does not cover their sojourn expenses
    2. inform Adria databanka on any change in person of sojourn participant
    3. pay Adria databanka the agreed advance payment that covers ordered services (based on service price calculation stated in Clause 3)
    4. check if all paid services are listed in Order Confirmation (Voucher)
    5. check if all travel documents and/or visas (if needed) are valid
    6. respect custom procedures and foreign currency regulations of the destination country
    7. follow instructions on specifics of sojourn, stated in information materials of Adria databanka
    8. show Order Confirmation (Voucher) to accommodation provider upon arrival to the accommodation unit and pay the remaining part of price stated in Voucher.
    9. follow terms of accommodation in the housing unit and co-operate with property owner 
    10. cover any damage caused by the client without delay on the spot
    11. inform Adria databanka immediately on any drawbacks in the place of sojourn. Such report shall be made directly from the place of sojourn.
    12. pay cancellation fee in accordance with Clause 6 in the event of Order Cancellation.
    13. cover expenses generated by client’s not respecting the above mentioned liabilities.
  8. Rights and liabilities of Adria databanka

    1. Adria databanka reserves the right:

      1. to change period and/or price of service on order (or cancel it completely) for reason of Force Majeure (see Clause 5). Such circumstance shall be negotiated with the client immediately 
      2. to withdraw from contract unilaterally as result of client’s breach of obligation. In such case the client is obliged to cover cancellation fee
      3. to expel the client from sojourn without entitlement to refund for unutilised service in the event that: (1) the client seriously breached legal regulations of the Czech Rep. and/or of the country visited; (2) the client seriously disrupted course of and/or programme of sojourn; (3) the client acted in rude and/or untactful manners towards the accommodation unit personnel.
      4. not to offer reimbursement to the client should the client, due to their own fault, fail to utilise services and/or breach the General Terms
      5. to act as follows in the event when a greater number of persons than is stated in order confirmation (Voucher) arrive to accommodation unit: the accommodation provider has the right to reject previously unannounced persons, or accept all clients on condition that unannounced clients pay for accommodation straight on the spot
    2. Adria databanka commits to:

      1. attend to service provision as well as to the service provider, to attend to rights and interests of clients in accordance with good custom practice of tourist industry
      2. provide the client with accommodation documents, i.e. confirmation of accommodation Order Placement (Voucher), which shall contain details about paid services and instructions for journey and sojourn
        Confirmation of accommodation Order Placement (Voucher) shall contain the following data:
        • name of the client
        • number of adult persons, number of and age of children
        • date of arrival and departure
        • name of accommodation unit as specified on www.adriadatabanka.com website
        • domestic name of accommodation unit
        • address of and telephone connection to the property owner (liable person)
        • name of property owner (liable person)
        • list of paid services
        • insurance data (if applicable) on persons, luggage, for the event of tour cancellation etc.
        • exact amount of supplementary payment
        • list of extra charges
        In accordance with client’s requirement, Adria databanka shall submit booking confirmation to either an individual person, or to a family, or to families that placed order jointly.
      3. inform client on prospective alteration in service and/or in price for accommodation
      4. render agreed services of due quality
      5. rectify clients‘ comments, complaints and claims immediately , alternatively after the client’s return to the Czech Rep., in accordance with Clause 6. 
  9. Personal data protection

    All personal data submitted by the client at the time of signing or sending an order are to be used by Adria databanka exclusively for internal use when processing the order. This means that personal data are to be used for the purpose of issuing deposit invoice, when updating the person in charge of the booked accommodation unit with necessary data, and when sending confirmation of order placement to the client’s address. Adria databanka binds to protect all gathered client’s data so that they are protected against loss and/or against any form of misuse. For this purpose Adria databanka utilises up-to-date, accessible technologies and procedures that are protected against unauthorised access.

  10. Copyright protection and observation

    The whole content of and all materials published on web pages of Adria databanka are designed solely for the purpose of non-commercial personal use. The content (or content sample) may not be altered, copied, distributed, displayed or presented as well as no information may be published or service or product sold by any means without prior permission of the copyright owner. All rights are reserved. The whole content of and the publication design of the website are possession of Adria databanka s.r.o., Panská 2, 602 00 Brno, Czech Republic, with the exception of several photographs that are in possession of accommodation unit owners and may be withdrawn at their request, should no other agreement be made. The purpose of the website is to provide reliable, high-level and truthful information on current offer in tourist industry. Adria databanka admits possible delays in updating information and endeavours to rectify inaccuracies immediately. Adria databanka’s website contains links to web pages which content may not be altered by Adria databanka’s employees. These links are meant to provide a source of information only and are in possession of other individuals. With regard to this fact, Adria databanka waives a responsibility for editorial practice of these websites. Adria databanka continues in observing the supplementary web links and shall cease use of a link should the content of the web site contradict valid laws. Notice

The General Terms of Use and Provision of Services are valid as of 1 September 2007. The Terms are an integral part of contractual relationship between the client and Adria databanka. The client gets acquainted with these Terms upon Order Placement and agrees to the Terms by signing and/or submitting the order. The client, whose name and address are used in the issued deposit invoice, binds to acquaint all travel companions with these General Terms.
